Article 1 – Parties

Seller:

Buyer: the person who places an order on zilaljewelry.com and provides their name, address, phone number and email address on the checkout page.

Article 2 – Subject

This contract sets out the rights and obligations of the parties regarding the sale and delivery of the products the Buyer orders electronically on zilaljewelry.com, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

Article 3 – Products, Price and Payment

The type and quantity of the products, their VAT-inclusive sale price, the shipping fee and the total amount are as stated in the order summary on the checkout page and in the order confirmation email.

Payment is made by credit or debit card via iyzico. For installment payments, any interest or installment charges are governed by the agreement between the Buyer and their bank.

Article 4 – Delivery

Products are sent via DHL to the delivery address given by the Buyer, within the legal maximum of 30 days from payment confirmation. If the Buyer is not available at the address, the Seller is deemed to have fulfilled its obligation.

If the product is to be delivered to a person or organisation other than the Buyer, the Seller is not responsible if that recipient refuses the delivery. The Buyer should check the parcel on delivery and ask the courier to record any damage in a report.

If the Seller cannot fulfil the order, for example because an item is out of stock, it will inform the Buyer and refund the amount paid within 14 days at the latest.

Article 5 – Right of Withdrawal

The Buyer has the right to withdraw from this contract within 14 days of receiving the product, without giving any reason and without paying any penalty. Withdrawal notices are sent to info@zilaljewelry.com or +90 505 059 99 95.

Within 10 days of the withdrawal notice, the Buyer returns the product with its original packaging, certificate (if any) and invoice. The Seller refunds the payment to the original payment method within 14 days of receiving the withdrawal notice, and may withhold the refund until the product has been received.

For returns from within Turkey sent via DHL using the return details provided by the Seller, the Seller pays the shipping cost. For returns from outside Turkey, except for defective items, return shipping and any customs costs are paid by the Buyer.

Article 6 – Exceptions to the Right of Withdrawal

Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to products prepared according to the Buyer’s requests or personal needs, items engraved with a name or letters, or earrings whose protective packaging or seal has been opened, for hygiene reasons.

Article 7 – Defective Products

For defective products, the Buyer’s optional rights listed in Article 11 of Law No. 6502 are reserved. For returns of defective products, all shipping costs are paid by the Seller.

Article 8 – Personal Data

The Buyer’s personal data is processed in accordance with Personal Data Protection Law No. 6698, as explained in our Privacy Policy and Personal Data Notice.

Article 9 – Dispute Resolution

For disputes arising from this contract, the Consumer Arbitration Committees and Consumer Courts at the Buyer’s or the Seller’s place of residence have jurisdiction, within the monetary limits set each year by the Ministry of Trade.

Article 10 – Entry into Force

By ticking the confirmation box on the checkout page and placing the order, the Buyer declares that they have read and accepted the Pre-Contract Information Form and all terms of this contract. The contract enters into force when the order is placed, and a copy is provided to the Buyer with the order confirmation email.
